商务部、科技部·Published 2026-10-16·Checked by 管理员 on 2026-10-17

China's Ministry of Commerce and Ministry of Science and Technology propose amending the Catalogue of Technologies Prohibited or Restricted from Export, adding 40 technologies across AI, biopharma, and photovoltaics, including 23 AI-related items covering large models, agents, computing clusters, and information processing. Technologies already in the public domain via open source or academic papers are excluded, and pre-export registration applies concurrently. Public consultation runs from 16 October to 15 November 2026.

What it means for you

  • Companies exporting large model, agent, or computing cluster technologies must complete export licensing or pre-export registration for the 23 AI items
  • Technologies already open-sourced or published academically are excluded, so open-source release remains a route outside the controls
  • Companies can submit comments on scope, metrics, and facilitation measures before 15 November 2026 to shape the final controls
  • What to do

LegalMap existing technology exports and outbound licensing involving large models, agents, and compute clusters against the controlled scope
