MOFCOM and MOST issued Announcement No. 48 of 2026, opening public consultation on revising the Export Control Catalogue with 40 technologies across AI, biopharma and photovoltaics — 14 prohibited and 26 restricted from export. The AI additions cover 23 technologies including large models, agents, computing clusters and information processing; AI-driven malicious code generation is proposed for prohibition. Open-source technologies already in the public domain fall outside control, and facilitation measures such as automatic licences apply to overseas self-built data centres; temporary pre-export registration applies meanwhile.

What it means for you

  • Overseas localised deployment of restricted large models falls under export control and requires a licence (automatic licence available for deployment on overseas self-owned cloud); API calls, SaaS apps and lightweight on-device deployment are outside scope.
  • Technologies already open-sourced or published are not controlled; open-source releases, overseas self-built compute centres and overseas chip fabrication qualify for automatic licence facilitation (near-instant approval).
  • Temporary pre-export registration applies to the proposed additions until the revision takes effect; companies exporting listed technologies must register first.
  • What to do

LegalMap your large-model, agent and compute-cluster technologies against the proposed restricted list to build an export screening inventory
ComplianceAssess compliance boundaries of overseas localised deployment vs API/SaaS models and adjust deployment architecture where needed
EveryoneSet up a process for the interim pre-export registration so exports of listed technologies are registered before proceeding
LegalSubmit industry comments in the public consultation on technical thresholds and facilitation measures
